The first 48 hours decide most claims
What you do in the two days after a crash shapes everything that follows, because the proof decays fast and the other driver’s insurer moves first.

How long you have to file
Two years from the date of the crash, under Civil Practice and Remedies Code section 16.003, and two years from the date of death in a fatal case.
Claims against a government driver are the exception and they move much faster. A city vehicle triggers a written notice requirement under Boerne’s own charter, at Section 10.03, long before the two-year deadline matters. Waiting also costs you proof: business and traffic video is usually overwritten within about 30 days, and damaged vehicles are sold for salvage with their data still inside.
