A truck accident is a collision involving a commercial truck, and it tends to cause severe injuries because a loaded tractor-trailer can weigh up to 80,000 pounds and needs far more room to stop than a car.

If one hit you on I-10, SH-46 or any road in Kendall County, you may pursue medical bills, lost wages, pain and suffering, and lost earning capacity.

Serving all of Boerne and Kendall County and every stretch of I-10, SH-46 and Main Street in between. Our aggressive Boerne truck and commercial vehicle aaccdent injury attorneys are ready to take your case to trial. A trial-tested team beside you, no matter the size of your claim.

Results our firm and of-counsel attorneys have obtained include $2 million from a jury in an underinsured-motorist claim; and more than $350,000 in policy limits for a family with three young children hurt in a collision. Jorge Mares, Of Counsel to JRE Injury Law, settled a T-bone case for $2.25 million as well

After an accident due to someone else’s negligence or deliberate acts, you can pursue your medical bills, your lost wages, your pain and suffering, and the earning power the crash took from you. Clients rate us 5.0 stars across 343 Google reviews, and when you call, you reach your attorney rather than a call center.

Boerne families can call (210) 272-0101 or use our secure contact form for a free case review. You Pay Nothing Unless You Win.

What should you do first after a truck crash?

Get medical care, then protect the proof before the trucking company’s team gets to it. Take these steps:

  1. Get checked the same day. Methodist ER Boerne treats emergencies, and serious trauma is transferred to a Level I trauma center.
  2. Note who responded: Boerne Police inside the city, the Kendall County Sheriff’s Office outside it, or DPS troopers on I-10. Order the CR-3 report from the TxDOT Crash Report Online Purchase System.
  3. Photograph the cab door, which shows the company name and USDOT number, plus the trailer and plates.
  4. Save your dashcam video, phone photos and witness names.
  5. Give no recorded statement to the trucking company’s insurer until you have advice.

We send a preservation letter in the first week, demanding that the carrier keep the truck, its electronic data and the driver’s records. While that goes out, we arrange your treatment with local providers and handle your vehicle repair or total-loss payout.

Why are truck crashes on I-10 harder to prove?

Because the truck, the driver and the records usually belong to a company that is not from here. I-10 carries Hill Country commuters alongside long-haul freight, and its exits put merging trucks beside slowing local traffic. TxDOT counted 70 crashes involving commercial motor vehicles in Kendall County in 2024, three of them fatal.

The proof in those cases sits inside company systems: electronic driver logs, which a carrier must keep for only six months under 49 CFR § 395.8(k), plus engine data, dispatch records and dashcam video. We demand all of it before it cycles out, then match it against the crash report and the scene. Our I-10 truck injury page covers that corridor, and our main truck and 18-wheeler claims page explains the federal rules in full.

Who can be held responsible besides the truck driver?

Usually more than one company, because the driver rarely owns the rig or sets the schedule. Responsibility can reach:

  • The motor carrier, under respondeat superior, for its driver’s on-the-job negligence, and for its own hiring, training and maintenance decisions
  • The employer whose worker was driving a company pickup or work truck
  • The shipper or loader, when cargo was overloaded or poorly secured
  • The owner of a leased or rented truck, for its own negligence
  • A freight broker that chose an unsafe carrier

If the defense blames you, Texas proportionate responsibility reduces your recovery by your share of fault and bars it only if you are more than 50% responsible (Civil Practice and Remedies Code § 33.001). We handle crashes involving rental moving trucks, UPS and FedEx trucks, Amazon delivery vans, dump trucks and tankers, along with the car accident claims that come out of the same pileups.

How much is a truck accident claim worth?

Your claim is worth the full value of your losses, reduced by your share of fault and limited in practice by the insurance available to pay. No average fits your case. You can seek past and future medical bills, lost wages and lost earning capacity, pain and suffering, physical impairment and disfigurement, and your vehicle repair or total-loss value. A family that loses someone can bring a wrongful death claim under Civil Practice and Remedies Code §§ 71.002 and 71.021.

Commercial coverage is the reason these cases are worth more than a car wreck. Interstate for-hire carriers must carry at least $750,000 for general freight, $1 million for oil and other hazardous materials, and $5 million for bulk hazardous substances and certain other dangerous loads (49 CFR § 387.9). Past results do not guarantee or predict a similar outcome. Every case is different and depends on its own facts.

How long do you have to file?

You generally have two years from the crash, and two years from the date of death for a wrongful death claim (Civil Practice and Remedies Code § 16.003). A child’s deadline usually waits until age 18.

If a government truck was involved, written notice is generally due within six months under § 101.101, and Boerne’s city charter (Section 10.03) lets the city set its own notice deadline by ordinance, which can be shorter. Truck records disappear long before any of these dates.

How does JRE Injury Law handle your case?

We prepare a truck case the way a jury will hear it, and we file it where you live: a Boerne case belongs in Kendall County’s district courts, the 451st and the 498th. Mr. Echavarria spent his early career as a Bexar County prosecutor, and he has recovered tens of millions of dollars for injured clients since.

The trial bench behind your case includes Ethan L. Shaw, Of Counsel to JRE Injury Law and a partner at Shaw Cowart, LLP, who is Board Certified in Personal Injury Trial Law and Civil Trial Law by the Texas Board of Legal Specialization. Their results in commercial vehicle cases include:

  • More than $200,000 for a client injured in an 18-wheeler crash (Shaw Cowart, LLP – Ethan L. Shaw Of Counsel to JRE Injury Law).
  • $125,000 by judgment against a trucking company in Babineaux & Mink v. Trammel Time Trucking, LLC (Shaw Cowart, LLP – Ethan L. Shaw Of Counsel to JRE Injury Law).
  • $2.25 million for a father and son in a T-bone crash, won by proving the driver was on the job rather than commuting (Jorge Mares Of Counsel to JRE Injury Law, with co-counsel David Fuentes).
  • Youngblood v. Fell, a four-fatality crash involving a rental truck, resolved by confidential settlement with Ethan L. Shaw, Of Counsel to JRE Injury Law, as lead counsel.
  • Bond & Wheeler v. Builders Systems Group: a confidential settlement for two workers hurt in a commercial auto accident (Shaw Cowart, LLP – Ethan L. Shaw Of Counsel to JRE Injury Law).
  • Confidential resolutions in other commercial trucking cases (Shaw Cowart, LLP – Ethan L. Shaw Of Counsel to JRE Injury Law).
  • Mr. Shaw has also defended an 18-wheeler operator to a take-nothing verdict in Deleon v. Merrick, so he knows how trucking companies and their insurers defend these cases.

Past results do not guarantee or predict a similar outcome. Every case is different and depends on its own facts. Read our client reviews or meet the team, then call (210) 272-0101 for a free case review. You Pay Nothing Unless You Win.

Do we have to come to you?

No. We can come to your home or your hospital room in Boerne, and a named case manager keeps you updated at every step, and Mr. Echavarria returns calls himself, including evenings.
