Hit by a Sports Car in San Antonio? What Injured Drivers Need to Know

 

A sports car accident is a crash involving a high-horsepower performance car, such as a Ferrari or Porsche, or even a Chevrolet Corvette, Ford Mustang or Dodge Challenger, and it often causes serious injuries because extra speed multiplies the force of impact.

Why Are Sports Car Crashes So Dangerous?

Sports car crashes are dangerous because powerful engines make high speed easy, and speed decides how hard a crash hits. The Insurance Institute for Highway Safety (IIHS) reported in July 2026 that midsize and large sports cars average 73 and 75 driver deaths per million registered vehicle years, about double the 37 average for all vehicles. The Chevrolet Camaro also ranked among the 20 models most deadly to drivers in other vehicles.

Crash energy rises with the square of speed, so a car at 60 mph hits with four times the energy of one at 30 mph.

Who Is Liable When a Sports Car Hits You?

The at-fault driver is liable first, because every Texas driver owes others reasonable care, and speeding breaks that duty. Others may share responsibility:

  • The owner, if they lent the car to a driver they knew was reckless. Texas calls this negligent entrustment.
  • Every driver in a street race, since Texas Transportation Code § 545.420 bans racing on public roads.
  • A rental company, only for its own negligence under the federal Graves Amendment, 49 U.S.C. § 30106.

Racing that injures someone is a third-degree felony under § 545.420. The violation can also prove fault through negligence per se, a rule that can treat breaking a safety law as proof of carelessness. San Antonio knows the risk, including a January 2023 street takeover at I-10 and Callaghan Road.

What Evidence Proves a Sports Car Was Speeding?

A car’s event data recorder (EDR), or black box, is often the strongest proof of speed because it logs what the driver did just before impact. Under federal rule 49 CFR Part 563, an EDR must save speed, throttle and braking for at least five seconds before a crash.

Some sports cars capture more. Chevrolet’s optional Performance Data Recorder, first offered on the 2015 Corvette Stingray, can record windshield-camera video overlaid with speed and braking data.

This evidence can vanish. Texas Transportation Code § 547.615 generally bars anyone but the owner from downloading EDR data without consent or a court order. A preservation letter, a written demand to keep the car and its data intact, helps prevent that loss.

What If the Sports Car Driver Doesn’t Have Enough Insurance?

Your own uninsured/underinsured motorist (UM/UIM) coverage can pay when the at-fault driver’s policy runs out. That happens often, because Texas requires only 30/60/25 liability limits: $30,000 per injured person, $60,000 per crash and $25,000 for property damage, according to the Texas Department of Insurance (TDI).

TDI notes that most auto policies exclude racing, so a street racer’s insurer may refuse to pay at all. Texas policies include UM/UIM unless the buyer rejected it in writing, so check your own policy.

What Should You Do After Being Hit by a Sports Car?

Get medical care first, then protect the evidence:

  1. Call 911 so police complete a Texas crash report (Form CR-3).
  2. Photograph both cars, skid marks and the sports car’s plate.
  3. Get witness contacts, especially anyone who filmed the crash.
  4. See a doctor right away, since concussion symptoms can appear days later.
  5. Decline a recorded statement to the other driver’s insurer.
  6. Call a lawyer quickly so the black box data is preserved.

Texas gives you two years to sue under Civil Practice and Remedies Code § 16.003. If you are blamed for part of the crash, § 33.001 still lets you recover a reduced amount as long as your share is 50 percent or less.
